The Family and Medical Leave Act (FMLA) of 1993 were established to assist employees with balancing work and personal life. The law was designed to give employees the assurance of not losing his or her job in the event one needed to take leave of absence to care for a family member or his or her own personal illness.
The following report provides information about a scenario that occurred at Fade In-Interior Auto Dealership. First, this report explains if it matters that a parent literally having nothing to do with a biological child in order for the child to take advantage of the Family and Medical Leave Act (FMLA) to care for that parent. Second, this report will explain whether the size of the business can have any effect on whether an employee Tony who’s employed at Fade In-Interior Auto Dealership is eligible for family leave under the FMLA. Third, this report explains whether the owner Herman can or cannot imply that if Tony takes a leave of absence under the FMLA, he may not have a job when he returns. Fourthly, this report will describe who is covered by the Family and Medical Leave Act of 1993. Lastly, this report will explain the extent to which an employee can make his or her own determination as to the eligibility of an employee under the Family and Medical Leave Act.

California’s Paid Family Leave and Implications for Federal Policy

...United States is the only country to not have a law granting paid family leave for mothers’ with a newborn. It was not until 1993, did the U.S. enact the Family and Medical Leave Act which allows workers time off to: bond with a newborn child; treat their own serious health condition; or care for a family member with a serious health condition. The intent for FMLA is to allow workers to balance family life with job obligations, but without wage replacement, many are unable to afford unpaid time off. Further, FMLA’s eligibility requirements exclude a substantial portion of the working population, primarily part-time, temporary, and vulnerable low-wage workers. Some states, such as California have taken action to ameloriate these pitfalls through paid family leave programs using state temporary disability insurance funds. California has been a frontrunner in many public health initiatives including being the first state to provide a comprehensive Paid Family Leave (PFL) program with “a wage replacement requirement for the time parents take to bond with a newborn or adopted child” (Cohen, 2011, p.2 ). This analysis will further examine California’s paid family leave program including its’ provisions, strengths, weaknesses, and its’ overall potential to be used as a template for future federal policy. However, the problem such idioms raise is whether the statements are an ethical way of temporarily saving face for those executives terminating their employment or the preservation of a company’s reputation in financial hardship. This case deals with virtue of honesty. When an employee leaves an organization, regardless of his or her position, the reason for the departure must be stated. Human Resources cannot delve further into the reasoning even if it seems much too vague or ambiguous. Unfortunately, if an executive or high-ranking employee terminates his or her position with an organization by stating he or she intends to spend more time with family, but, in reality, is either seeking other employment opportunities or, perhaps, has knowledge that the company he or she is working for is failing financially, than he or she has committed an ethical breach.
