Is This Your Contract

BUS 311: Business Law I
Instructor:

What is something that we all go thru at one point in our lives, something that makes our word our bond. We agree to something and we decide to put it on paper for how long no matter what comes up we stick to it. Now contract can be so testy we don’t know if we are breaching it or right on task. There are contract almost everywhere that we go, when we get a car, buy a house, even when you sign up for a credit card you are putting yourself in a contact. Now every time that you think about something that you want to get into a contract with, it's always smart to think research and make sure that what you are doing is great for you. For example people everyday get into a new car contract because they really need it. Now I have done this in the past but before we got into the contract I made sure that we were able to afford it. Now something that my wife does is takes all the information that we gathered from the car lot and made sure that it would fit in our budget. Now after a long talk we were able to come to the decision that we would take the car. But we wanted to make sure that this is something that really wanted to, I know that if we were not going to be able to afford it then we would be in more trouble for not having that ability to pay for it. Now we are really going to get into this car contract a little deeper and by that I mean we are going to see what is good and what is bad about all decision that will be made in the final hours of the contract. So we will skip past the months that you test drive, and research everything about the new vehicle that you want. And when I mean new I mean 2014 or 2015, the reason why is because having a new car is a lot better then having used new car. Plus there are so many laws that protect you from certain scams that can happen with a used car. Now you…...

This Land Is Your Land, Incomplete

...This Land is Your Land, Incomplete The poem “This Land is Your Land” by Woody Guthrie is originally a seven stanza poem that is often cut short in the recorded versions known to many. The poem’s main element is imagery of America’s landmarks to evict an emotion out of the reader. The first four stanzas have a much more celebratory tone compared to the final three. In the recorded versions, the last three stanzas are cut out, so as to not dampen the joyful tone of the song. The change in tone of the poem is easily broken into two parts. The first part makes the reader feel proud of America by describing some of its national symbols and declaring in the last lines of each stanza. “This land was made for you and me.” (4,8,12,16.) These first four stanzas have a common theme of Guthrie taking in America’s beauty while feeling blessed to be in its land. Guthrie describes the sights as “sparkling sands” (10.) and “golden valley” (7.) to make the reader feel pleased and almost proud of our land. The first four stanzas have been sung and used to celebrate America in most patriotic settings. The last part of the poem has been left out of the mainstream recorded versions and few realize that there are three more stanzas in the original. The last three stanzas take a different tone by describing the land of America in a darker way than the first four. This tone changes the main line “This land was made for you and me” from a joyful voice to a sadder, matter of fact,......

...Contracts Just because the contractor has been selected as the winner does not mean the contractor can start doing the work. Before the project can proceed, a contract must be signed between the customer and the contractor. A contract is a vehicle for establishing good customer–contractor communications and arriving at a mutual understanding and clear expectations to ensure project success. It is an agreement between the contractor, who agrees to perform the project and to provide a product or service (deliverables), and the customer, who agrees to pay the contractor a certain amount in return. The contract must clearly spell out the deliverables the contractor is expected to provide. For example, a contract will state that the project result will meet certain specifications or that certain documentation will be provided. The contract must also state the terms by which the customer will make payments to the contractor. There are basically two types of contracts: fixed-price and cost-reimbursement. FIXED-PRICE CONTRACTS In a fixed-price contract, the customer and the contractor agree on a price for the proposed work. The price remains fixed unless the customer and the contractor agree on changes. This type of contract provides low risk for the customer because the customer will not pay more than the fixed price, regardless of how much the project actually costs the contractor. However, a fixed-price contract is high risk for the contractor because if the cost of completing...

...Roseali Drawbaough Theory to Practice When entering into a contract, it is important to note the elements of what makes a contract a legal binding agreement between two parties. The Theory to practice case is between Mr. Chou and BBT. Mr. Chou agreed soul distributorship on a 90-day contract agreement in return that BBT paid a sum for Mr. Chou’s product. Agreement, mutual assent, consideration, and capacity legality made up the two parties entrance into the contract. As in the case of BBT and Mr. Chou all contracts have differences to how they are perceived, what makes them legal in oral and written form that can either be remedied or voided by various laws and regulations. Questions 1-6 1. At what point, if ever, did the parties have a contract? Insurance Contracts This Project Deals with the Accounting for Insurance Contracts. as Stated on the Site, “Accounting for Insurance Contracts Does Not Provide Users with the Information They Need to Meaningfully

...Insurance Contracts This project deals with the accounting for insurance contracts. As stated on the site, “accounting for insurance contracts does not provide users with the information they need to meaningfully understand the insurer’s financial position, performance and risk exposure.” Additionally, IFRS does not provide the proper guidance to how insurers should handle certain issues. The main goal of the Insurance Contracts project is to provide a single principle-based standard to account for all types of insurance contracts. Also, because comparability between entities is largely lacking today, the Insurance Contracts project also aims to enhance the comparability of financial reporting between them. The Insurance project is broken down into 2 phases. The first phase coincides with the issuance of ‘IFRS 4 Insurance Contracts,’ which “offered limited improvement in account by insurers and enhanced disclosures on amount, timing and uncertainty of future cash flows from insurance contracts.” Phase 2 will be the issuance of a new Insurance Contracts Standard, which will actually replace IFRS 4 (Insurance Contracts). Leases The Leases project deals with the reporting of lease information to investors and analysts. The main goal of the project is to develop a new standard that will establish the guidance for entities to follow on reporting information regarding the amount, timing and uncertainty of cash flows arising from a lease. As stated in the work plan,......

What Does This Contract Reveal to You About the Nature of Sharecropping? Was This System a Good One for Both the Sharecropper and the Landowner?

...What does this contract reveal to you about the nature of sharecropping? Was this system a good one for both the sharecropper and the landowner?  Explain.  I believe what the contract reveals about the nature of sharecropping is that it was set up to set the “freed” African American for failure and to put them in such debit that they basically became slaves to the landowner once again. The landowner has left a lot of responsibility to the sharecropper obviously I think a good example of this in this contract is that the landowner has agreed to provide the team but the sharecropper has to feed the team Saturday nights, and every other day morning night a day and if he fails to provide the meal he will then owe the landowner 5 cents, which was a lot of money at the time especially for a poor sharecropper. He also has to pay for his half of the manure which the landowner designates as enough of the crops. This system is so beneficial to the landowner but only allows the sharecropper enough to thrive to live. I don’t believe this system was good for both the sharecropper and the landowner. I believe as earlier stated it was one sided to the landowner. The sharecropper had a lot of responsibility while all the landowner did was provided the land and horses for the sharecropper and then reaped all the benefit finically. He got a low cost of labor and once the debit piled up from the landowners harsh expectations basically free labor out of this. This landowner even went as......
